Notice of Public Hearing – City Council – April 4, 2022, 7:00 p.m.

NOTICE IS HEREBY GIVEN that on Monday, April 4, 2022, at 7:00 p.m. in the City Council Chambers located at 5111 Benito Street, Montclair, CA 91763, and via Zoom video and teleconference (meeting link: https://zoom.us/j/93717150550 / Dial Number: 1-(669)-900-6833 / Meeting ID: 937-1715-0550), the City Council of the City of Montclair will conduct a public hearing concerning the following:


  • Resolution No. 22-3341 – Consider the proposed issuance by the Independent Cities Finance Authority (the “Authority”) of its mobile home park revenue refunding tax-exempt bonds in one or more series in the aggregate principal amount of not to exceed $23,000,000 (consisting of up to $23,000,000 allocated to the Hacienda Mobile Home Park, up to $23,000,000 allocated to the Monterey Manor Mobile Home Estates, and up to $23,000,000 allocated to the Villa Montclair Mobile Home Park, each park as further described herein and each allocation made at the discretion of the park owner, but in no event to exceed $23,000,000 in the aggregate) (the “Authority Bonds”) pursuant to Chapter 8 of Part 5 of Division 31 of the California Health and Safety Code. Certain requirements of the City to its approval of such issuance are set forth in a draft Resolution of the City Council of the City, a copy of which is on file with the City Clerk as a public record and is available for public inspection. Any approval shall be subject to the provisions set forth in such Resolution, including without limitation Section 1 thereof and Exhibit “A” thereto.

The proceeds from the sale of the Authority Bonds, if any are issued, are intended to be used to make a loan to Augusta Communities LLC, a California limited liability company, or a related party (the “Borrower”), to be used, along with other funds available to the Borrower, to payoff certain loans and refund certain revenue bonds previously issued by the Authority, the proceeds of which were loaned to the Borrower to finance the acquisition and renovation of (i) a mobile home park with approximately 204 spaces known as the Hacienda Mobile Home Park located in the City at 4361 Mission Boulevard, (ii) a mobile home park with approximately 140 spaces known as the Monterey Manor Mobile Home Estates located in the City at 11250 Ramona Avenue and (iii) a mobile home park with approximately 96 spaces known as the Villa Montclair Mobile Home Park located in the City at 5580 Moreno St. (collectively, the “Projects”); (iv) finance additional renovations to be made to the Projects; and (v) finance certain costs of issuing the Bonds. The Borrower will be the owner and operator of the Projects.

This public notice is intended to comply with public notice requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended. The Projects are required to be occupied in part by persons of low and very low income in accordance with California laws and the requirements of Section 145 of the Internal Revenue Code of 1986, as amended.

If you challenge the final decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council of the City of Montclair at, or prior to, the public hearing. Subject to exhaustion of administrative remedies, Code of Civil Procedure Section 1094.6 requires you to initiate such proceeding in court within 90 days of the final decision in this matter.

Subsequent to the public hearing, the City Council will consider approving the issuance of the Authority Bonds.

INVITATION TO BE HEARD:  All interested persons will be given an opportunity to comment on the above-referenced item at the public hearing and any subsequent public hearings conducted related to the item.  In addition, written comments may be submitted to the City Council prior to the hearing via U.S. Mail to the attention of City Clerk’s Office, City of Montclair, P.O. Box 2308, Montclair, CA, 91763; by completing the online public comment submission form at https://www.cityofmontclair.org/public-comment/; or via email to cityclerk@cityofmontclair.org. Please reference the hearing title and date of the hearing in any correspondence.

If you wish to challenge the above item in court, the challenge will be limited only to those issues you or someone else raised at the public hearing in written correspondence delivered to the City at or prior to the public hearing as described in this notice.  The City cannot be held responsible for U.S. Mail that is not received prior to the hearing.
