NOTICE IS HEREBY GIVEN that on Monday, August 15, 2022, at 7:00 p.m. in the City Council Chambers located at 5111 Benito Street, Montclair, CA 91763, and via Zoom video and teleconference (meeting link: https://zoom.us/j/93717150550 / Dial Number: 1-(669)-900-6833 / Meeting ID: 937-1715-0550), the City Council of the City of Montclair will conduct public hearings concerning the following:


1. Ordinance No. 22-999

Consider adoption of Ordinance No. 22-999 adding Chapter 4.46 to Title 4 of the Montclair Municipal Code related to imposing a Cannabis Business License Tax (subject to final approval by the votes at the Tuesday, November 8, 2022 General Municipal Election), and setting a public hearing for second reading and adoption of Ordinance No. 22-999 for Monday, August 15, 2022, at 7:00 p.m.


2. Resolution No. 22-3366 / Planning Case No. 2021-33

APPLICANT:  Montclair Station Apartments LLC

PROJECT LOCATION:  A 9.96-acre vacant parcel (former location for Vulcan Building Materials) located approximately 200 feet west of the intersection of Monte Vista Avenue and Richton Street, west of the San Antonio Creek Channel.  Current address 4700 Huntington Drive.

ASSESSOR PARCEL NUMBER(S): 1007-722-03

PROJECT DESCRIPTION: A Parcel Map No. 20474 and a Precise Plan of Design (PPD) for a 302-unit Apartment Community on a 9.96-acre site.  The project is known as Montclair Station.

EXISTING GENERAL PLAN: “Planned Development”

EXISTING ZONING: “Corridor Residential” per the North Montclair Downtown Specific Plan.

ENVIRONMENTAL ASSESSMENT:  Pursuant to State CEQA Guidelines, Section 15164, the City of Montclair (City) has prepared an Addendum to the North Montclair Downtown Specific Plan Amendment Project Final Supplemental Environmental Impact Report (SCH No. 2009091021) for the proposed Montclair Station Project.  A modified initial study checklist was prepared to determine if any of the conditions specified in State CEQA Guidelines Section 15162 requiring preparation of a subsequent or supplemental EIR or MND would occur as a result of the modification proposed by the Montclair Station Project.  On the basis of the analysis contained within the modified initial study, the City has determined that the Montclair Station Project is consistent with the original North Montclair Downtown Specific Plan Amendment Project Final Supplemental Environmental Impact Report (SCH No. 2009091021) certified by the City of Montclair City Council on March 20, 2017, [Resolution No. 17-3147] and would not result in new impacts or any substantial changes to any significant effects previously identified.  Thus, an Addendum was prepared to document the minor changes to the certified North Montclair Downtown Specific Plan Amendment Project Final Supplemental Environmental Impact Report (SCH No. 2009091021).

The application and CEQA documentation (Addendum and original EIR) may be viewed at the Community Development Department located at the above address, from 7:00 a.m. to 6:00 p.m., Monday through Thursday prior to the public hearing.
