Notice of Public Hearings – City Council – February 5, 2024, 7:00 p.m.

NOTICE IS HEREBY GIVEN that on Monday, February 5, 2024, at 7:00 p.m. in the City Council Chambers located at 5111 Benito Street, Montclair, CA 91763, and via Zoom video and teleconference (meeting link: https://zoom.us/j/93717150550 / Dial Number: 1-(669)-900-6833 / Meeting ID: 937-1715-0550), the City Council of the City of Montclair will conduct public hearings concerning the following:


  • Second Reading — Consider Adoption of Ordinance No. 24–1005 amending Title 11 of the Montclair Municipal Code, adding definitions to Chapter 11.02, and adding Section 11.38.100 and amending Chapter 11.77 allowing  the use of monitored electrified fences in specified commercial and industrial zones within the City subject to certain standards/conditions and the process to review such requests (Planning Case No. 2023-35)

On November 27, 2023, the Planning Commission of the City of Montclair conducted a public hearing on the proposed Ordinance and voted 5-0 on Planning Commission Resolution No. 23-1988 recommending City Council adoption of a proposed Ordinance to amend Title 11 of Montclair Municipal Code.

Environmental Assessment:  The ordinance is exempt from environmental review under the California Environmental Quality Act (CEQA) under Public Resources Code Section 15061(b)(3) (Common Sense Exemption), 15301 (Existing Facilities), 15303 (New Construction or Conversion of Small Structures), and 15311 (Accessory Structures) of the CEQA Guidelines.


  • Consider Projects and Prioritization of Funding for the Fiscal Year 2024-25 Community Development Block Grant Program

Any additional documentation related to the above items may be reviewed at least 72 hours prior to the hearing by contacting the City Clerk’s Office by telephone at (909) 625–9416 or by email at cityclerk@cityofmontclair.org to request to be emailed digital copies of the documents; or by downloading the agenda packet for the City Council meeting posted on the City’s website at https://www.cityofmontclair.org/council-meetings/ and reviewing the documents within the agenda packet.

INVITATION TO BE HEARD:  All interested persons will be given an opportunity to comment on the above-referenced items at the public hearing and any subsequent public hearings conducted related to the items.  In addition, written comments may be submitted to the City Council prior to the hearing via U.S. Mail to the attention of City Clerk’s Office, City of Montclair, P.O. Box 2308, Montclair, CA, 91763; by completing the online public comment submission form at https://www.cityofmontclair.org/public-comment/; or via email to cityclerk@cityofmontclair.org. Please reference the hearing subject and date of the hearing in any correspondence.

If you wish to challenge any of the above item in court, the challenge will be limited only to those issues you or someone else raised at the public hearing in written correspondence delivered to the City at or prior to the public hearing as described in this notice.  The City cannot be held responsible for U.S. Mail that is not received prior to the hearing.
