Notice of Public Hearing – Planning Commission – June 14, 2021, 7:00 p.m.

NOTICE IS HEREBY GIVEN that on Monday, June 14, 2021, at 7:00 p.m. in the City Council Chambers of City Hall located at 5111 Benito Street, Montclair, CA 91763, and via Zoom video/teleconference (meeting link: https://zoom.us/j/95858571900, or dial: 1-669-900-6833, Meeting ID: 958-5857-1900), the Planning Commission of the City of Montclair will conduct a public hearing concerning  the following:

1. Case No. 2021-17Case No 2021-17

PROJECT ADDRESS:  9631, 9635, & 9655 Monte Vista Avenue

ASSESSOR PARCEL NUMBER:  1008-651-45, 46, and 47

APPLICANT(S):  Chendu Holding, LLC, property owner

PROJECT DESCRIPTION: A Tentative Parcel Map and Conditional Use Permit for a three-unit commercial condominium project on a 3.9-acre site.  The Condominium Plan would apply to the three existing medical-use buildings (one building currently under construction) on the site.

ZONING:  “AP” (Administrative Professional)

GENERAL PLAN:  Office Professional

ENVIRONMENTAL ASSESSMENT:  The Planning Division has determined this project to be categorically exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Section 15301(k) (Class 1 – Existing Facilities) and Section 15315 (Minor Land Divisions) of the State CEQA Guidelines.  The project qualifies because the proposed project is on a developed site, involves no expansion of the existing buildings, and the division of the three medical buildings into a commercial condominium development.  Other minor exterior and interior tenant improvements, parking lot, and landscaping enhancements are also covered by Section 15301(a).

DOCUMENTATION: The CUP and Tentative Parcel Map application, along with the environmental findings, and staff recommendations may be viewed at the Community Development Department located at City Hall, 5111 Benito Street, Montclair, CA 91763 from 7:00 a.m. to 6:00 p.m., by appointment, Monday through Thursday prior to the public hearing.  Meeting agenda, reports, and other documentation will be available on the City’s website at https://www.cityofmontclair.org/planning-commission-meetings/ at least 72 hours prior to the public hearing. 2. Accessory Dwelling Units and Junior Dwelling Units in Residential Zones

ORDINANCE NO. 21-996: Consider amending Title 11 of Montclair Municipal Code, Chapters11.02, 11.16, 11.18, 11.19, 11.20, 11.22, and 11.36 of the Montclair and replace Chapter 11.23 Municipal Code relating to Accessory Dwelling Units and Junior Dwelling Units in Residential Zones.

RESOLUTION NO. 21-1947: Consider recommending that the City of Montclair City Council adopt an Ordinance, and Zoning Code Amendment 2021-16 to amend Title 11 of Montclair Municipal Code, Chapters11.02, 11.16, 11.18, 11.19, 11.20, 11.22, and 11.36 of the Montclair and replace Chapter 11.23 Municipal Code relating to Accessory Dwelling Units and Junior Dwelling Units in Residential Zones. and finding this Ordinance to be Exempt for the California Environmental Quality Act.

ENVIRONMENTAL ASSESSMENT: The project is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21080.17 and CEQA Guidelines Section 15282(h), which states that “the adoption of an ordinance regarding second units in a single-family or multifamily zone by a city or county to implement the provisions of Sections 65852.1 and 65852.2 of the Government Code” are exempt from the requirements of CEQA. Similarly, the ministerial approval of ADUs would not be a project for CEQA purposes, and environmental review would not be required prior to approving individual applications.

Please reference the hearing body, subject, and date of hearing in any correspondence.

If you wish to challenge any of the above items in court, the challenge will be limited only to those issues you or someone else raised at the public hearings in written correspondence delivered to the City at or prior to the public hearings as described in this notice.  The City cannot be held responsible for U.S. Mail that is not received prior to the hearings.
