Pursuant to GC § 36933(c)(1), the City must publish a summary of a proposed ordinance or a proposed amendment to an ordinance provided that the summary is posted in the manner specified in GC § 36933(a) at least five (5) days prior to adoption of the proposal and within fifteen (15) days after adoption with the names of the Council Members voting for and against the proposal.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR ADOPTING ZONING CODE AMENDMENT NO. 2024–21 TO REPEAL AND REPLACE CHAPTER 11.23 OF THE MONTCLAIR MUNICIPAL CODE RELATING TO ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS IN THE CITY OF MONTCLAIR AND DETERMINING THE ORDINANCE TO BE EXEMPT FROM CEQA

Summary

The Ordinance amends the Zoning Code and repeals and replaces Chapter 11.23 of the Montclair Municipal Code relating to Accessory Dwelling Units and Junior Accessory Dwelling Units in Residential Zones to be in compliance with state law.

History

The Ordinance was introduced for first reading at a regular City Council meeting held on Monday, June 3, 2024, which was approved by a 3-0-1-1 vote (Ruh, Johnson, and Dutrey in favor; Lopez abstained; Martinez absent).

A Public Hearing is scheduled to take place before the City Council at its regular meeting on Monday, June 17, 2024, at 7:00 p.m. in the Council Chambers located at City Hall, 5111 Benito Street, Montclair, California to hear comments from the public prior to consideration of the Ordinance’s adoption.

Effective Date

30 days after adoption.
