Proposition 64 Compliance

On Monday, December 9, 2019, in the City Council Chambers, the Planning Commission held a public hearing regarding Planning Commission Resolution No. 19-1935 recommending the City Council adopt Ordinance No. 19–983. As part of the public hearing, a presentation was made updating the Planning Commission on Proposition 64 compliance and the Planning Commission took the following actions:

  1. Move that, based on the evidence submitted, that a finding was made that proposed Ordinance No. 19–983 is exempt from further CEQA review pursuant to (1) Business and Professions Code section 26055(h); (2) Public Resources Code section 21083.3 and State CEQA Guidelines section 15183; (3) State CEQA Guidelines Sections 15152 and 15168; (4) State CEQA Guidelines Section 15301; (5) State CEQA Guidelines Section 15061(b)(3); and (6) State CEQA Guidelines sections 15060(c)(2) & (3); and
  2. Adopted Planning Commission Resolution No. 19–1935 recommending the City Council adopt an ordinance to repeal Chapter 11.11 of title 11 of the Montclair Municipal Code regarding medical cannabis dispensaries, cultivation and processing, commercial cannabis activities, delivery of cannabis and cannabis-related products and outdoor cultivation of cannabis, and replacing it with Chapter 11.11 to title 11 of the Montclair Municipal Code entitled “COMMERCIAL CANNABIS USES”.

Public Hearing Resolution No. 19-1935 — Monday, December 9, 2019

On Thursday, May 9, 2019, at 6:00 p.m. in the City Council Chambers, the City Council conducted a special meeting regarding Proposition 64 Adult Use of Marijuana Act (AUMA) and the potential for a series of draft ordinances regulating commercial cannabis activity in the City of Montclair. The special meeting was conducted to present the City Council the concepts contained in the draft ordinances, and to determine if the City Council desires to proceed with public hearings. A continuation of the special meeting was held on Thursday, May 30, 2019, at 6:00 p.m. in the City Council Chambers.

The types of commercial cannabis activities proposed in the draft ordinances include: indoor cultivation, manufacturing, testing, distribution, retail–storefront, non–storefront retail, and microbusiness of medicinal and adult-use cannabis and cannabis products, as well as the ancillary transportation and delivery of cannabis or cannabis products.

As stated, the ordinances are in draft form, and are not yet available for public release; however, copies of the draft ordinances are available for public review at City Hall, 5111 Benito Street, Montclair, CA 91763.
