Pursuant to GC § 36933(c)(1), the City must publish a summary of a proposed ordinance or a proposed amendment to an ordinance provided that the summary is posted in the manner specified in GC § 36933(a) at least five (5) days prior to adoption of the proposal and within fifteen (15) days after adoption with the names of the Council Members voting for and against the proposal.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR AMENDING CHAPTER 11.02 OF THE MONTCLAIR MUNICIPAL CODE AND ADDING A NEW CHAPTER 11.21 AND A NEW CHAPTER 11.87 RELATING TO URBAN LOT SPLITS AND TWO–UNIT PROJECTS AND DETERMINING THE ORDINANCE TO BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

Summary

The Ordinance amends Chapter 11.02 and adds Chapters 11.21 and 11.87 to the Montclair Municipal Code allowing an Urban Lot Split and/or Two–Unit project in the R-1 single-family residential zone consistent with Senate Bill 9. All Urban Lot Split and Two–Unit projects would be subject to administrative review based on an applicant’s ability to meet all the objective design standards contained in proposed Ordinance No. 24–1007 without discretionary review.

The Ordinance was introduced for first reading at a regular City Council meeting held on Monday, March 4, 2024, which was approved by a 5-0 vote (Dutrey, Johnson, Ruh, Martinez, Lopez).

The Ordinance was read a second time at a regular meeting on Monday, March 18, 2024, and was adopted unanimously by a 5-0 vote (Dutrey, Johnson, Ruh, Martinez, Lopez).
