Title

ORDINANCE NO. 25-1013

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR AMENDING CHAPTER 8.02 (“DEFINITIONS”) AND ADDING CHAPTER 8.38 (“PARKING OF OVERSIZED AND RECREATIONAL VEHICLES AND UNATTACHED TRAILERS ON PUBLIC STREETS AND HIGHWAYS”) OF TITLE 8 (“VEHICLES AND TRAFFIC”) OF THE MONTCLAIR MUNICIPAL CODE

Summary

The City Council has proposed amending the Montclair Municipal Code to establish regulations for oversized vehicles, recreational vehicles (RVs), and unattached trailers parked on public streets. Addressing safety issues such as blocked visibility, reduced roadway space, and long-term street storage, the ordinance prohibits oversized vehicles and unattached trailers from parking in residential areas, and restricts oversized vehicle parking in nonresidential areas between 10:00 p.m. and 5:00 a.m. Exemptions apply to vehicles engaged in loading or service work, government and utility vehicles, buses transporting specific groups, and emergency situations. This ordinance will enforce parking location requirements for such vehicles, prohibiting parking near intersections, driveways, traffic lanes, or any areas that may pose safety hazards. A permit system will be available for residents in due course to obtain temporary RV parking permits for either short-term (up to 72 hours) or long-term (up to 7 days), subject to annual limits and specific application procedures.

History

The Ordinance was introduced for first reading at a regular City Council meeting held on Monday, December 1, 2025, which was approved by a 4-0-1 vote (Dutrey, Martinez, Ruh, and Mendez voting in favor; and Lopez absent).

The Ordinance was read a second time at a regular meeting on Monday, October 20, 2025, and was adopted by a 5-0 vote (Dutrey, Martinez, Ruh, Lopez, and Mendez voting in favor).
