Ballot Measures

NOTICE IS HEREBY GIVEN that a General Municipal Election will be held in the City of Montclair on Tuesday, November 8, 2022, at which there will be submitted to the voters the following measures:


MEASURE R

Shall the measure funding general Montclair services, including supporting 911/police/fire response; preventing thefts/property crime; recruiting/retaining firefighters, paramedics; retaining local business/jobs; repairing streets/potholes; addressing homelessness; by taxing cannabis retail, delivery, cultivation, manufacturing/testing businesses at a rate of not more than 7% of gross receipts, raising about $3,500,000 annually, until ended by voters, requiring audits, spending disclosure, funds used locally, cannabis businesses follow laws protecting public health/safety, be adopted?

MEASURE II

Shall the Montclair City Council consider approving ordinances legalizing and licensing medical and adult–use cannabis businesses in the City of Montclair?

YES / NO


NOTICE IS FURTHER GIVEN that pursuant to Article 4, Chapter 3, Division 9 of the Elections Code of the State of California, the legislative body of the City, or any member or members thereof authorized by the body, or any individual voter or bona fide association of citizens, or any combination of voters and associations may file a written argument titled either “Argument in Favor of Measure ___” or “Argument Against Measure  ___”, not to exceed 300 words in length, accompanied by the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers who is the author of the argument, for or against a City measure. A Form 9600 must also be submitted (Exhibit A).

NOTICE IS FURTHER GIVEN that, based upon the time reasonably necessary to prepare and print the arguments and Voter Information Guide for the election, the City Clerk has fixed Monday, August 22, 2022, at 12:00 p.m., as the date after which no arguments for or against a City measure may be submitted to the City Clerk for printing and distribution to the voters as provided in Article 4. Arguments may be changed or withdrawn until and including the date fixed by the City Clerk.

NOTICE IS FURTHER GIVEN that if direct arguments are filed, rebuttal arguments titled either “Rebuttal to Argument in Favor of Measure ___” or “Rebuttal to Argument Against Measure ___”, not to exceed 250 words in length, may be submitted by the authors of opposing direct arguments, and filed with the City Clerk, accompanied by the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers who is the author of the argument. A Form 9600 must also be submitted (Exhibit A).

NOTICE IS FURTHER GIVEN that, based upon the time reasonably necessary to prepare and print the rebuttals and Voter Information Guide for the election, the City Clerk has fixed Thursday, August 25, 2022, at 6:00 p.m., as the date after which no rebuttals to arguments for or against a City measure may be submitted to the City Clerk for printing and distribution to the voters as provided in Article 4. Rebuttals may be changed or withdrawn until and including the date fixed by the City Clerk.

NOTICE IS FURTHER GIVEN that if more than one argument for or more than one argument against any City measure is submitted, the City Clerk shall select one of the arguments in favor and one of the arguments against each measure, as set forth in Elections Code Section 9287.

NOTICE IS FURTHER GIVEN that any proposed ordinance, ballot question, impartial analysis, direct argument, or rebuttal argument filed under the authority of the Elections Code will be available for public examination in the City Clerk’s office for 10 calendar days following the deadline for the filing of said proposed ordinance, ballot question, impartial analysis, direct argument, or rebuttal argument.

The polls will be open between the hours of 7:00 a.m. and 8:00 p.m. on Election Day.
