Pursuant to GC § 36933(c)(1), the City must publish a summary of a proposed ordinance or a proposed amendment to an ordinance provided that the summary is posted in the manner specified in GC § 36933(a) at least five (5) days prior to adoption of the proposal and within fifteen (15) days after adoption with the names of the Council Members voting for and against the proposal.

ORDINANCE NO. 25-1015

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR AMENDING THE NORTH MONTCLAIR DOWNTOWN SPECIFIC PLAN TO ALLOW MEDICAL USES WITHIN THE STATION DISTRICT LAND USE ZONE (CASE NO. 2025–06).

Summary

The City Council has proposed a specific plan amendment initiated at the request of Village Partners Ventures LLC, the developer of the Village at Montclair, a mixed-use development located at the intersection of Arrow Highway and Fremont Avenue. This project is situated within the Station District zone of the NMDSP and is nearing completion. The developers wish to allocate a portion of their mixed-use leased space to a dental practice, which is currently not permitted within the Station District of the NMDSP. Proposed Ordinance No. 25–1015 seeks to amend the land use section of the NMDSP to explicitly permit “Medical Services – Doctor/Dentist Office” as an allowable use within the Station District zone. This amendment would update Table 5–2, Allowable Land Uses and Permit Requirements, located in Chapter 5 of the municipal code, changing the designation from Not Permitted to Permitted. If approved, this change would enable medical uses, under the revised definition, to be permitted within the SD zone, aligning it with the existing allowances in the Town Center (TC) zone of the NMDSP. The NMDSP is a form-based code designed to foster a walkable, pedestrian-oriented environment that combines retail and residential uses, creating a vibrant “place” near the Montclair Transcenter. It is divided into four land use zones: the Station District (SD), Town Center (TC), Corridor Residential (CR), and Neighborhood Residential (NR).

History

The Ordinance was introduced for first reading at a regular City Council meeting held on Monday, September 15, 2025, which was approved by a 5-0 vote (Dutrey, Martinez, Ruh, Lopez, Mendez voting in favor).

A Public Hearing is scheduled to take place before the City Council at its regular meeting on Monday, October 15, 2025, at 7:00 p.m. in the Council Chambers located at City Hall, 5111 Benito Street, Montclair, California to hear comments from the public prior to consideration of the Ordinance’s adoption.

Effective Date

30 days after adoption.
