Mandatory Public Official Training

California law (California Government Code Sections 53234 through 53235.2, commonly referred to as “AB 1234”; and California Government Code Section 53237 through 53237.5, or "AB 1661") requires local agency officials, designated employees, legislative body members, and appointed commissioners to receive two hours of ethics (AB 1234) and two hours of sexual harassment prevention (AB 1661) training and education within the first six months of appointment and every two years thereafter if the agency provides any type of compensation, salary, or stipend to those officials.

California law (California Government Code Section 12950.1) also requires that all employers of 5 or more employees provide 1 hour of sexual harassment and abusive conduct prevention training to nonsupervisory employees, and 2 hours of sexual harassment and abusive conduct prevention training to supervisory employees, every two years.

Training Requirements

Elected Officials and Commissioners

Members of the City of Montclair City Council, Planning Commission, and Community Activities Commission are subject to the requirements of AB 1234 and AB 1661. Commissioners who do not complete these required trainings on time and remain in compliance with both AB 1234 and AB 1661 may be removed from their appointed seats, pending City Council action.  Newly-elected/appointed Council Members and newly-appointed Commissioners who have not received the training elsewhere within the last two years must complete both training courses within  six months of starting service with the City. After the initial training courses are completed, two hours of ethics and sexual harassment training must be completed every two years.

Employees

Employees designated in the City's Conflict of Interest Code are also subject to AB 1234 Ethics Training every two years.

Supervisors and managers must take two hours of Sexual Harassment Prevention Training, and all other employees must complete the one hour non-supervisory training, every two years.

Obtaining Training

THE BELOW-PROVIDED ONLINE COURSES ARE TIMED AND YOUR TRAINING CERTIFICATES MUST SHOW AT LEAST 2 HOURS WAS SPENT COMPLETING THE TRAININGS (ONE HOUR OF SEXUAL HARASSMENT PREVENTION TRAINING FOR NON-MANAGEMENT/NON-SUPERVISORY EMPLOYEES).

Courses are available through various other providers and employers. Please confirm with the training provider in advance that the training complies with the requirements of AB 1234 or AB 1661.  Some good sources of compliant training are the Institute for Local Government and the League of California Cities (CalCities), which may offer live online webinars or in-person training sessions at conferences.

Submitting Certificates

City Employees

Once you complete a training course, you will receive a training certificate. Please sign your certificate (if required), keep a copy for your records, and submit it to your department head.  The City will retain the certificates as a public record for at least two years.

City Council Members, Planning Commissioners, and Community Activities Commissioners

Once you complete a training course, you will receive a training certificate. Please sign your certificate (if required), keep a copy for your records, and submit it to the City Clerk’s Office by email to cityclerk@cityofmontclair.org, in person to the City Clerk, or by mail to City Clerk's Office, City of Montclair, 5111 Benito Street, Montclair, CA 91763. You can also log into your Netfile account (Log in with your email address and reset the password if you haven't set one or forgot it) and upload your certificate there instead to fulfill your upcoming deadline. If you took an online training that allows your certificate to be e-mailed directly to the agency for which the certificate is required, you may have it sent to cityclerk@cityofmontclair.org rather than printing and signing it. The City will retain the certificates as a public record for at least five years.

Checking Compliance Status

You are out of compliance if more than two years have passed since the date on your currently-filed certificates of training. If you do not have copies of your most recent certificates, you can request them from the City Clerk.

Council Members and Commissioners may log into NetFile (www.netfile.com/filer) to check training compliance status (Log in with your email address and reset the password if you haven't set one or forgot it).
